Abstract: The legal deadline to apply for the approval of active substances which are used in treated articles and not yet in the approval process is 1 September 2016. If the treated articles do not meet the regulatory requirements by the deadline, they can only be placed on the market until 1 March 2017. In order to avoid the heavy penalty from the European Union and reduce the impact on the trade to the minimum, the treated articles enterprises should check the state of the active substance and prepare the special label under BPR in time. It has been more than 2 years since Biocidal Products Regulation (BPR, Regulation (EU) 528/2012) applied from 1^st September 2013. The legal deadline to apply for the approval of active substances which are used in treated articles and not yet in the approval process is 1st September 2016. According to the Article 94 of BPR, if the active substances for the relevant product-type relevant with the treated article are not contained in the work programme on 1 September 2016, or approved, or included in Annex I of BPR, an application for approval for the relevant product-type about the active substance should be submitted by 1 September 2016. Otherwise the treated articles can only be placed on the market until 1 March 2017. What’s more, it will take more than half a year to prepare the active substance application dossier. Therefore, time is limited.
