Following the UK’s departure from the European Union, the EU Cosmetics Regulation (EC) No 1223/2009 was retained and adapted into domestic law through The Product Safety and Metrology etc. (Amendment etc.) (EU Exit) Regulations 2019. From January 1, 2021, all cosmetic products placed on the Great Britain market must comply with the UK Cosmetics Regulation. Products placed on the Northern Ireland market still need to comply with the EU Cosmetics Regulation.

  • November 30, 2009 – The EU adopts Cosmetic Regulation (EC) No 1223/2009.

  • June 2013 – UK issues the Cosmetic Products Enforcement Regulations 2013, granting domestic enforcement of the EU regulation.

  • July 11, 2013 – Regulation (EC) No 1223/2009 becomes effective in the UK as an EU member.

  • March 27, 2019 – The UK amends retained EU law via the Product Safety and Metrology etc. (Amendment etc.) (EU Exit) Regulations 2019. Schedule 34 specifically revises the cosmetic regulation.

  • January 1, 2021 – The amended UK Cosmetic Regulation officially comes into force.

Definition of a Cosmetic Product

(EC) No 1223/2009 (UK Cosmetics Regulation): ‘cosmetic product’ means any substance or mixture intended to be placed in contact with the external parts of the human body (epidermis, hair system, nails, lipsand external genital organs) or with the teeth and the mucous membranes of the oral cavity with a viewexclusively or mainly to cleaning them, perfuming them, changing their appearance, protecting them, keepingthem in good condition or correcting body odours.
