EU Proposes Ethanol Approval for PT 1, 2 and 4 Biocidal Products

Updated on

EU BPR REGULATORY UPDATE

The World Trade Organization (WTO) recently circulated a Technical Barriers to Trade (TBT) notification from the European Commission. The notification presents a draft implementing regulation proposing the formal approval of ethanol as an active substance for use in product-types 1, 2, and 4 biocidal products, in accordance with the Biocidal Products Regulation (BPR, Regulation (EU) No 528/2012). The draft is proposed for formal adoption in February 2027.

Status: Draft proposal      Scope: PT 1, PT 2 and PT 4      Proposed approval: 1 May 2028

Background to the Ethanol Review

Ethanol is widely used as a disinfecting agent in healthcare, hygiene and food processing. In February 2026, the Biocidal Products Committee (BPC) of the European Chemicals Agency (ECHA) adopted opinions supporting its approval for disinfectant uses.

However, the assessment did not resolve whether ethanol should be considered carcinogenic or toxic to reproduction. Further data are being generated on exposure routes relevant to biocidal uses, including dermal and inhalation exposure. To avoid delaying the review programme for existing active substances, the Commission is proposing approval subject to specific conditions.

Proposed Approval Scope and Timeline

The WTO notification G/TBT/N/EU/1237 concerns a draft implementing regulation and its annex. The proposed approval covers the following substance specifications, product-types and dates.

ItemDraft Provision
Active substanceEthanol
IdentificationCAS No. 64-17-5
EC No. 200-578-6
Minimum purity of the evaluated active substance92.6% (weight/weight)
PT 1Human hygiene biocidal products
PT 2Disinfectants and algaecides not intended for direct application to humans or animals, including uses in private and public health areas
PT 4Food and feed area disinfectants
Proposed adoptionFebruary 2027
Proposed approval date1 May 2028
Proposed approval expiry30 April 2038

These dates remain proposed and are subject to the final adopted regulation. Active-substance approval and authorisation of individual biocidal products are separate steps under the BPR.

Proposed Conditions for Products and Treated Articles

Product-Specific Risk and Efficacy Assessment

At the product authorisation stage, the draft would require particular attention to exposures, risks and efficacy associated with uses not addressed in the Union-level assessment. Companies should therefore assess whether their intended uses and exposure scenarios are adequately supported by available data.

Toddler Exposure for PT 2 and PT 4

For PT 2 and PT 4 products, the assessment would need to pay particular attention to exposure risks for children (toddlers). This proposed condition makes relevant toxicological information and exposure assessments an important preparation priority.

Labelling of Treated Articles

Under the draft, persons placing articles treated with or incorporating ethanol on the market would need to ensure that labels provide the information required by Article 58(3) of the BPR, including relevant instructions for use and precautionary measures. The applicable requirements should be assessed against Regulation (EU) No 528/2012 and the final approval conditions.

What Manufacturers and Exporters Should Prepare

If adopted, the proposal would establish an approval date for ethanol and a basis for the transition from national transitional arrangements to BPR product authorisation requirements for the relevant uses. Adoption, entry into force and the active-substance approval date are distinct milestones; companies should plan against the applicable transition provisions and final dates.

Greece, the evaluating Member State, also plans to submit a dossier concerning ethanol's harmonised classification and labelling under the CLP Regulation. Future hazard-classification developments remain relevant to manufacturers' regulatory planning and should be monitored alongside the BPR approval process.

  1. Conduct a data-gap analysis. Compare existing safety and efficacy data for ethanol disinfectant products with BPR authorisation requirements. Pay particular attention to intended uses, exposure scenarios and information needed to assess risks to toddlers.

  2. Review product status, labels and instructions. Determine whether each product is a biocidal product or a treated article before selecting its compliance route. A treated article with a primary biocidal function is considered a biocidal product under the BPR, so disinfectant wipes should not automatically be classified as treated articles. For products that qualify as treated articles, review the applicable Article 58 information, warnings and use instructions.

  3. Plan authorisation applications in advance. For existing products covered by the Article 89 transitional arrangements, the relevant authorisation or mutual-recognition applications must be submitted no later than the applicable active-substance approval date. Where a product contains more than one active substance, the relevant date is the approval date of the last active substance for that product-type. Confirm the product-specific deadline and prepare the dossier well ahead of it.
