To prevent raw material shortages from halting domestic manufacturing amidst global supply chain disruptions, South Korea has taken decisive regulatory action. Effective April 10, 2026, the Ministry of Climate, Energy and Environment (MCEE) has activated a temporary special provision under the Act on Registration and Evaluation of Chemical Substances (K-REACH).
This measure allows companies facing supply crises to substitute mandatory hazard test data with formal testing plans during the chemical registration process. The move compresses a procedure that typically takes over three months into a matter of days — a critical relief measure for industries heavily reliant on imported chemical raw materials.
K-REACH Registration Bottleneck Addressed
Under the existing K-REACH framework, any chemical substance imported into South Korea must be registered with the MCEE prior to importation. This registration requires the submission of comprehensive hazard test data covering physicochemical properties, human health effects, and environmental impact.
Obtaining these test results through accredited laboratories typically requires three months or more. When global supply chains face unexpected bottlenecks, this lengthy timeline makes it practically impossible for companies to pivot swiftly to new overseas supply sources. Recognizing this barrier, the MCEE acted through an active administration review board to implement the fast-track provision ahead of formal legislative amendments, prioritizing urgent industrial needs.
Scope and Designation Process for Supply Crisis Substances
The fast-track provision is not universally available to all chemical importers. It applies exclusively to substances officially designated as "chemical substances in supply crisis" (수급위기 화학물질). The designation process works as follows:
A company experiencing import difficulties reports the affected chemical substance to the Ministry of Trade, Industry and Energy (MOTIE).
MOTIE assesses whether a genuine supply chain disruption exists.
If confirmed, MOTIE formally requests the MCEE to apply the special provision to that substance.
Only after this inter-ministerial consultation and official designation can a company invoke the fast-track registration pathway.
Companies adopting this special provision must ensure their testing plans comply with hazard categories specified in the revised K-REACH Enforcement Rules, and prepare to fulfill standard data requirements for all registrations beyond the December 2027 deadline.
Companies Benefiting from the K-REACH Fast-Track Provision
The following types of companies are strongly advised to pay attention to this Fast-Track registration provision:
Companies urgently need to switch suppliers and needing to complete K-REACH registration for new raw materials within a short timeframe;
Companies shifting from domestic procurement in South Korea to direct imports and becoming subject to K-REACH registration obligations for the first time;
Companies in sectors highly exposed to naphtha supply volatility — including paints & coatings, petrochemicals, and plastics — as well as their upstream raw material suppliers.
Companies should assess whether their substances qualify for designation as “Supply Crisis Chemical Substances” based on their operational circumstances, and plan their registration pathways early to fully leverage this regulatory window.
Legislative Status and Expiration Date
The special provision is formally embedded in the draft partial amendment to the Enforcement Rules of K-REACH, which the MCEE published for public consultation on April 8, 2026. Due to the urgency of the matter, the consultation deadline was shortened to April 21, 2026.
Once the formal amendment is enacted (expected within April 2026), it will extend the temporary special provision's expiration date to December 31, 2027. This timeline serves as an outer boundary to provide regulatory certainty during extended periods of international trade restrictions or logistical disruptions.
