China Began ADM Expiry Review on SMZ Imports from India

The original anti-dumping duties on SMZ imports from India started from 15 June 2007 (MOFCOM announcement No 48 of 2007) and would end on 15 June 2012 if no expiry review petition were raised by the domestic industry for continued anti-dumping measures 60 days prior to the termination date. On 30 March 2012, the ministry received a review petition submitted by Shouguang Fukang, a pharmaceutical firm based in Shandong province of China, applying for extension of the 5-year anti-dumping time limit, on behalf of the Chinese sulfamethoxazole industry. The petition demonstrates that the petitioner’s production volume of SMZ products in 2011 had occupied more than 50% of the total domestic production over the same period. Therefore, according to Article 48 of China Anti-Dumping Regulation, MOFCOM decided to make final ADM review on the product. The period of expiry review will look into dumping investigations from 1 January 2011 to 31 December 2011; and the period of injury investigation from 1 January 2007 to 31 December 2011. The expiry review investigation will last one year till 15 June 2013. During the investigation, MOFCOM will maintain its original anti-dumping levy range and margin deposits in compliance with Announcement No 48 of 2007.
